Judicial Reforms

To my Indian Friends

Justice Delayed is Justice Denied- Quoting this saying the retired Chief Justice of India Sr. V.N.KHARE has observed that tyhe present scenario in the Indian Judiciary needs immediate revamping and restructuring in respect of disposal of pending cases and also in settling the disputes in diferent courts adopting Fast Track measures. The inadequacy of officials in the Judiciary is a major factor in the deteriorating condition of the System. When compared to the ratio of Judges to the population in other countries, we are running at a very low ebb.The ratio that prevails in foreign countries is 135 to 150 Judges for every 10 lakhs population where as our position is as low as 13.5 Judges for every 10 lakhs population.

Does it not sound ridiculous? When we have a population of 100 crores or more what should be our requirement?. We need a minimum strength of 1,50,000 Judges to deal with the crimes both Civil and Criminal. The present state of affairs will take us to more than ONE LIFE SPAN to settle the cases pending in each court! That means, we are virtually captived in PRISON, before a decision is taken in a particular case. Also it may be that the Judge who initiated action in the beginning stage of a particular case may not LIVE to see the End result of that case!. If this is the reality we face, then we have to STRIKE OTHER CHORDS. Harping on the Same String will not help us to get through the difficult moments we are passing through.

The crisis as it is presented gives rise to a feeling that we are not committed in our approach to the burning problems confronting us in the fast developing world. Unless we gear up our Machinery to match with the developed world we may miss the target we aim at , causing delay and disharmony in public life. I am in full support of the suggestion that departments like POLICE/JUDICIARY should be independant bodies with out STRINGS ATTACHED and with out Political Interference.Therefore Codes and Practices should undergo timely changes to suit the prevailing Life Style and behaviour of people ,which do not fully relate to the Constitutional Provisions meant for the earlier generations. The old Wine in New bottle concept will upset OR imbalance the peaceful existence of the people of India. REFORMATION IS A NECESSITY. Therefore let us make up the Time loss and Trigger up activities in all Fronts with full commitment and involvement in the progress of the NATION in its competition with the other neighbouing countries.
